ApniGully terms of use:

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and amended provisions pertaining to electronic record. This document is published in accordance with the provisions of rule 3(1) of the Information Technology (Intermediaries guidelines) rules, 2011 that requires publishing the rules & regulations privacy policy & terms of use for access or usage of ApniGully application for mobile. When you access the platform you agree to be bound by these terms and conditions.

Changes:

We may periodically change the Terms and the Site without notice, and you are responsible for checking these Terms periodically for revisions. All amended Terms become effective upon our posting to the Site, and any use of the site after such revisions have been posted signifies your consent to the changes.

Terms & Conditions:

• We use a diverse range of information, text, photographs, designs, graphics, images, sound and video recordings, animation, content, advertisement and other materials and effects (collectively "Materials") for the search services on the Platforms. We provide the Material through the Platforms FOR YOUR PERSONAL AND NON-COMMERCIAL USE ONLY.

• While every attempt has been made to ascertain the authenticity of the Platforms content, ApniGully is not liable for any kind of damages, losses or action arising directly or indirectly, due to access and/or use of the content in the Platforms including but not limited to decisions based on the content in the Platforms which results in any loss of data, revenue, profits, property, infection by viruses etc.

• All information displayed on the ApniGully App, related to a shop are made available to the users on best effort basis and ApniGully can not gaurantee the correctness of such information.

• ApniGully app may ask for the access of mobile location to display distance of the shop. Without appropriate location permission, location of a shop can't be displayed.

• Information displayed on the app are either taken from public domain or provided by shop owners.ApniGully does not display any confidential information about shop and its owners.

• Only Registered shops of ApniGully will be displayed on the ApniGully mobile application.

• ApniGully is the medium to bring Shops & Customers together & we are not responsible for any commitments given by Shop/Business establishments regarding discounts or any special offers.

• There are no financial transactions allowed through this App.

• All payments between customer & store will happen at the store billing section & ApniGully will not be responsible for any correctness in the Billing.

• The customer has to ascertain the billing total for it correctness, before making any payment to the

• Shop/Business establishment either by Cash, Card or Cheque.

• ApniGully may tie up with Stores or Brands or Online Advertisers & there shall be no objection.

• Minor Children are required to seek permission from their Parents before they engage in any financial transaction with the Shops.

• All disputes if any in regards to pricing, quality of product has to be resolved by customer & store and

• ApniGully shall hold no responsibility towards the same.

• Any false representation of our App or copying of the App design, logo without our authorization will be considered as crime & ApniGully will held such persons or company or organisation responsible & legal action will be taken in accordance with the India Law.

• You shall not make any negative, derogatory statements or comments about ApniGully App.

• ApniGully will not be responsible for any damage caused to your mobile or handheld device in any form.

• ApniGully App is not doing any financial transactions, hence we are not required for your KYC documents and we neither saving any such data with us in written or electronic form.

• You shall not engage in purchasing any product or services which is not allowed by Law. All responsibility lies with the customer and shop for their products and services.

• ApniGully reserves the right not to upload and not to publish through the Site or Forums any Communication which:

1. is obscene, indecent, pornographic, profane, sexually explicit, threatening, or abusive.

2. constitutes or contains false or misleading indications of origin or statements of fact.

3. slanders, libels, defames, disparages, or otherwise violates the legal rights of any third party.

4. causes injury of any kind to any person or entity.

5. infringes or violates the intellectual property rights (including copyright, patent and trademark rights), contract rights, trade secrets, privacy or publicity rights or any other rights of any third party.

6. violates any applicable laws, rules, or regulations.

7. contains software viruses or any other malicious code designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

8. impersonates another person or entity, or that collects or uses any information about Site visitors.

.All rights, title and interest including trademarks and copyrights in respect of the domain name and Platforms content hosted on the Platforms are reserved with ApniGully. Users are permitted to read, print or download text, data and/or graphics from the Website or any other Platforms for their personal use only. Unauthorized access, reproduction, redistribution, transmission and/or dealing with any information contained in the Platforms in any other manner, either in whole or in part, are strictly prohibited, failing which strict legal action will be initiated against such users.
